Transfer Your Indefinite Leave to Remain (ILR) From Your Old Passport
If you have your Indefinite Leave to Remain (ILR) in a legacy document, in a passport that is valid, lost, stolen, or expired, or have no proof of your indefinite leave status or if you have a new passport and you wish to have your Indefinite Leave to Remain (ILR) status transferred to Biometric Resident Permit, you will need to apply for no time limit Biometric resident permit (BRP).
Alternatively, if you have Indefinite Leave to Remain and you have retained your old passport, you may travel with both the old and the new passports. However, some airlines may give you a hard time before boarding. In the same way, an expired passport with a visa will make it harder for you to find employment in the UK.
Furthermore, it can be problematic if you already have a job and want to continue to work for your employer. This is because your employer is legally required by the Home Office to verify your right to work in the country.
They are required to follow the ‘Employers’ Guide to Right to Work Checks’, which states that you must be able to present “A current passport endorsed to show that the holder is allowed to stay in the UK and is currently allowed to do the type of work in question”. So, an employer may refuse to employ you if your visa is an expired passport.
Once you have submitted your application to transfer your Indefinite Leave to Remain (ILR) from your old passport, your employer can contact the Home Office to verify that the application is in progress and your right to work in the UK. Once they have confirmation, they may employ you or let you continue to work.
Who is eligible for a no time limit biometric residence permit?
To be eligible for an NTL biometric residence permit, you must have indefinite leave to enter or remain in the UK. This includes those who were considered ‘settled’ in the UK on or before 1 January 1973. You must also not have lost your indefinite leave to enter or remain, for example by being absent from the UK for a continuous period of 2 years or more since 2000.
